About This Course
More and more operators are asked to host gas-fired generators and computing loads, such as cryptocurrency mining and data centres, on well sites and facility leases. This course teaches the land side of such a project from a licensed agent's own file: who the parties are, how to choose a site with a seven-point review, how much of the lease the new use takes and how to draw it, and the lease-sharing agreement between the operator and the newcomer, clause by clause. Under Flowers v Persist Oil and Gas Inc. (2025 ABKB 142, affirmed 2026 ABCA 172), an oil and gas surface lease does not cover bitcoin mining, so the course shows how to get the landowner's own grant for the new use, notify the neighbours and keep the records for an audit. It is not legal advice; it shows what to recognise and when to involve the company's lawyer.
It is for practising Alberta surface land agents, land administrators and project coordinators. It is designed as continuing-competence learning for Alberta land agents, at an intermediate level rather than entry-level training.
What you will learn
- Identify the parties to an on-site power or computing project and what each holds, and tell behind-the-fence from grid-connected
- Apply Flowers v Persist to a surface lease and explain why a right-of-entry order, regulator approvals and a neighbour's non-objection do not give the right a new use needs
- Choose a structure for the land rights and list what each option must cover
- Read a surface lease sharing agreement clause by clause and spot what it is missing
- Assess candidate sites with a seven-point review and draw the footprint used as the agreement's schedule
- Prepare the neighbour notice and keep the notification records for an audit
