About This Course

Every wellsite, pipeline and facility touches someone else's interest: another operator's pipeline, lease or road, a timber holder, a county road, a landowner whose land a road crosses. This course follows the third-party side of a surface land file: asking for a consent and giving one, writing the request, tracking it until the approval is received, executed and filed, and putting each agreement in the package in the right order. It then covers the letter consents for proximity, parallel and encroachment, the facility crossing agreement, road use with its rates, invoices and road bans, and the four ways to share an existing site or right-of-way.

It is for practising Alberta land agents and surface land administrators who request, track and file third-party consents for an operator or a broker, and for operator staff who answer other companies' requests. It is designed as continuing-competence learning for Alberta land agents, at an intermediate level rather than entry-level training.

What you will learn

  • Tell a file where your company asks for a consent from one where another company asks you, and follow the steps for each
  • Choose and complete the right request letter, and track it on the third-party line list until the approval is executed, returned and filed
  • Know which consents are needed before the licence application and which before construction, and when to cancel a request
  • Explain what proximity, parallel, encroachment and facility crossing agreements require of the requesting operator
  • Set up road use under a road use agreement and addendum, calculate and invoice charges, and manage rate changes and road bans
  • Compare lease sharing, lease usage, joint use and shared right-of-way agreements by what each shares, who pays, who maintains, who reclaims and how each ends
